Policy and Disclaimers for Proposal Kit's AI Writer

AI Credits Policy

• AI Credit Usage: Users purchase AI Credits stored in their user account. These credits are required to use the AI Writer feature to generate proposals and business documents.
• Non-Transferable Credits: AI Credits purchased by users are non-transferable between accounts.
• Refunds: AI Credits are non-refundable once purchased, regardless of whether they are used or unused.

Account and User Id Policy

• Single Instance Access: Each User Id may only access the AI Writer feature from one (1) instance at a time. Multiple logins using the same User Id to access the AI Writer are prohibited.
• User Ids per Order: A maximum of five (5) User Ids can be assigned per software order number. Exceeding five User Ids requires the purchase of an additional Proposal Pack, Contract Pack, or Proposal Kit Professional software license.

Data Handling and Privacy

• Third-Party AI Engine: Information provided through the AI Writer will be sent to third-party AI engines to fulfill content generation requests. Proposal Kit, Inc. does not opt-in to allow third-party AI engines to retain or use your data for their model training purposes.
• Temporary Data Storage: Data transmitted to Proposal Kit Inc.'s servers for AI processing is temporarily stored. The user can manually purge this data immediately upon completing their tasks. Otherwise, it will be automatically purged after a short period.

User Responsibility and Liability

• User Responsibility: The AI Writer is a time-saving tool providing initial tailored content. Users are responsible for reviewing, editing, verifying, and ensuring the accuracy and correctness of all final content generated through the AI Writer.
• Liability Disclaimer: Proposal Kit, Inc. holds no liability for inaccuracies, errors, or omissions in content generated by third-party AI engines. The results generated by the AI Writer depend heavily on the quality of information users supply.
• Third-Party Services and Downtime: Proposal Kit Inc. assumes no liability for content or issues arising from third-party AI services, including downtime, service interruptions, or quality of AI-generated content.

License and Access Conditions

• Conditional License: Continued access to the software and AI Writer features is contingent upon a valid license payment. Software licenses will be disabled immediately upon returns, chargebacks, or invalidated payments.
• Modification and API Usage Restrictions: Users are prohibited from calling or modifying the AI Writer API outside the designated Wizard software.

Abuse and Policy Violations

• Account Suspension: Proposal Kit, Inc. reserves the right to suspend or terminate user accounts immediately for abusive behavior, policy violations, or unauthorized activities involving AI Writer access and usage.

AI Content Accuracy and Disclaimer

• Training Limitations: The AI models used by the AI Writer may not be trained on the latest real-time information. Users should clearly instruct the AI Writer to include current information when needed to enhance the accuracy and relevance of generated content.
• Disclaimer on AI Output: Proposal Kit, Inc. disclaims responsibility for AI-generated inaccuracies or failures to adhere to specific user instructions. Users are responsible for ensuring AI-generated proposals and documents meet their business requirements and standards.

Intellectual Property and Copyright

• Proposal Kit, Inc. retains no ownership rights or claims to the content generated by the AI Writer. Users are solely responsible for ensuring that the generated content does not infringe upon third-party intellectual property rights.

Indemnification

• Users agree to indemnify, defend, and hold harmless Proposal Kit, Inc., its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from the user's use of the AI Writer or generated content.

Service Availability and Modifications

• Proposal Kit, Inc. reserves the right to alter, modify, limit, or discontinue the AI Writer feature or related services at any time without prior notice. Proposal Kit, Inc. is not liable for any claims or damages resulting from such changes or discontinuation.

Limitation of Liability

• In no event shall Proposal Kit, Inc. or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, revenue, data, or business interruption) arising from or related to your use or inability to use the AI Writer, even if Proposal Kit, Inc. has been advised of the possibility of such damages.

Governing Law and Jurisdiction

• These policies and disclaimers shall be governed by and construed by the laws of the jurisdiction in which Proposal Kit, Inc. operates, without regard to conflicts of law principles. Users agree to submit exclusively to the jurisdiction of the courts located within that jurisdiction.

By using the AI Writer and associated AI Credits, you acknowledge and agree to the terms outlined above. Proposal Kit, Inc. reserves the right to update these policies and disclaimers periodically, and continued use of the service constitutes acceptance of any changes made.
